Di nuovo sul processo Mills. Di nuovo sui giudici. Vale la pena di analizzare brevemente qualche frase. Per chi non lo ricordasse Nicoletta Gandus è il giudice che si sta occupando di tale processo.
[E'] curioso sostenere, come ha fatto la Corte d’Appello, che Nicoletta Gandus, pur essendo un mio palese nemico politico, nel momento in cui arrivasse a scrivere una sentenza nei miei confronti saprebbe non venir meno al vincolo d’imparzialità impostole dalla Costituzione
Basiamoci allora sullo stesso principio usato qui dal premier: è altresì curioso sostenere che Berlusconi sarebbe in grado di mantenere scissi gli interessi privati da quelli pubblici (cioè i nostri interessi). Ad esempio, da Presidente del Consiglio ha in mano la Rai, da imprenditori le altre reti private concorrenti della stessa Rai…
[Continuo] ad avere fiducia nei giudici perchè alla fine sono sempre stato assolto e soprattutto perchè la maggioranza dei giudici è composta da magistrati indipendenti e coscienti della sacralità della propria alta funzione
Aspetta. Quindi ciò che conta è il risultato non la correttezza delle sentenze. E ancora: i magistrati imparziali quindi sono solo quelli che se la prendono con lui. O meglio, secondo il principio da lui usato, i magistrati imparziali sono quelli che non lo vogliono assolvere così su due piedi ma vogliono indagare.
Questo commento chiarisce sicuramente ciò che volevo dire:
Berlusconi ammette [che il Lodo Alfano] è una legge ad personam, ed è scandaloso che il capo del governo utilizzi il Parlamento e le istituzioni per tutelare i suoi interessi privati. Le parole del premier e il ringraziamento rivolto ai parlamentari del centrodestra, che gli hanno regalato l’utile legginà non sono certo una sorpresa per chi ha denunciato la natura fondamentalmente autoritaria di Berlusconi e l’incompatibilità tra i suoi devastanti conflitti d’interesse e le più elementari regole del confronto democratico. Come è già successo più volte, qualcosa stride nelle parole del Premier. Mai dimenticarsi dell’importanza delle parole e di come si possono torcere a nostro favore. Perchè, come si è visto, il Premier spesso dice anche la verità. Bisogna solo togliere la lieve patina dorata.

Again about Mills trial. Again about judgers. It’s worth analysing briefly a few statements. For the one who forgot it, Nicoletta Gandus is the judger working on this trial.
[It's] curious claiming, as the Corte d’Appello did, that Nicoletta Gandus, unless being clearly a political enemy of mine, wouldn’t go back on the impartiality bond, imposed by the Constitution, when coming to hand own a sentence on me.
On the basis of the same principle used above by him: it’s also curious claiming that Berlusconi would manage to keep his privat interests and the public ones ( =our interests) apart. For instance, as Prime Minister he holds Rai, as an entrepreneuer he holds the other privat channels, competitors of Rai.
[I keep on] trusting judgers because in the end I’ve always been acquitted and mainly because the majority of the judgers is made up of independent magistrates, who are conscious of the sacrality of their high office.
Wait. Then the important thing is the result not the accuracy of the sentences. Going on: impartial magistrates are only those having it in for him. Better said, according to the principle he used, impartial magistrates are only those who don’t want to acquit him on the spot but want to investigate.
This comment clarifies what I wanted to say:
Berlusconi admits [that the Alfano award] is an ad personam law, and it’s scandalous that the Prima Minister uses the parliament and the istitutions to safeguard his private interests. His words and his thanking toward tha centre-right parliamentarians, who present him the useful law come certainly as no surprise for those who denounced the extremely authoritarian nature of Berlusconi and the incompatiblity between his devastating conflict of interest and the most elementary rules of the democratic exchange. As it happened many times, there’s something hawkward in Berlusconi’s words. Never forget the importance of words and how they can be twisted in our favour. Because, as we saw, our Prime Minister says often the truth. We’ve only to remove the soft golden coat.
